PRODUCT AVAILABILITY

The availability of our products depends on seasonal variations as the raw materials procured for manufacturing our products are naturally sourced, which may result in our products not being available at all times on the Website. Product availability is also subject to stock levels. We reserve the right to discontinue or limit quantities of any product at any time. If a product becomes unavailable after you place an order, we will inform you and offer a suitable replacement or refund.

PRICING AND TAXES

All products listed on the Website will be sold at maximum retail price unless otherwise specified. The prices declared on the Website for the respective product are in Indian Rupees (INR) and “inclusive” of taxes. The prices mentioned at the time of ordering will be the prices charged on the date of delivery. In case the prices are higher or lower of the concerned product, on the date of delivery, no additional charges will be collected or refunded as the case may be at the time of delivery. Unless otherwise specified, prices quoted are “exclusive” of the costs of shipping or carriage to the agreed place of delivery. You agree to pay for taxes (if any), shipping or carriage of Products as such costs are specified by us on the Site when you submit your purchase order.

Prices may be indicated on the website or an order acknowledgement but the authoritative price in the event of any discrepancy, is the price that is notified to you on our Acceptance before the time of dispatch or delivery. We reserve the right to update product pricing at any time without prior notice. The final price charged will be the price displayed at the time of checkout. If there is error in pricing and we notify you the same prior to product dispatch and in such event if you choose to continue with fulfillment of the order, you acknowledge that the Product or Service will be provided in accordance with such revised description or corrected price.

Unconditional and Irrevocable Payment shall be made while placing order and by such methods as are indicated on the Site (and not by any other means unless we have given our prior agreement).

ORDER ACCEPTANCE AND CONFIRMATION

All orders placed on the website are subject to acceptance and confirmation. Prior to such acceptance, an automatic e-mail acknowledgement of your order may be generated. Please note that any such automatic acknowledgement does not constitute a formal acceptance of your order.

Our acceptance of your order takes effect and the contract concluded at the point where such offer is expressly accepted by us dispatching your order and accepting your credit card or other payment (“Acceptance”).

Upon successful order placement and payment, you will receive an order confirmation email/SMS with order details. Be sure that information provided by you when placing your order is up-to-date materially accurate and is sufficient for us to fulfill your order.

Before placing an order, you will check and verify the product description carefully. By placing an order for a product you are bound by the conditions of sale included in the product’s description.

ORDER REJECTION

We may reject your order (without liability) if we are unable to process or fulfill it. If this is the case, we will refund any prior payment that you have made for that item in terms of our Refund Policy. We reserve the right to cancel or refuse any order at our discretion, including but not limited to:

A) Non-availability of stock

B) Errors in product or pricing information

C) Payment failure or suspicion of fraudulent activity

D) Violation of applicable laws or these Terms

PAYMENT

All online payments are processed through secure third-party payment gateways. While placing an order on the Website, you are allowed to choose from the various payment options made available. You undertake to use your own debit/ credit card or banking details for completing the transaction on the Website. At the time of payment, if all security checks are verified through the secured server for enabling the online transaction, then The Herb Shop shall not be held responsible for misuse of your debit/ credit card or banking details. The Herb Shop will not be liable for any type of credit card fraud. The onus of proving that your credit card has been fraudulently used for transacting on the Website will be exclusively on you. We do not store your card or banking credentials. In the case of payment failure or chargeback, the order will be cancelled automatically.

B) UPI

C) Net Banking

D) Digital Wallets (Paytm, PhonePe, etc.)

SHIPPING AND DELIVERY

All Products purchased from the Website shall be delivered to the User by standard courier services through a logistics partner. We will try its level best to make sure that you receive your order as fast as possible but due to certain external circumstances, your order might take a while longer to get delivered. It is the customer’s responsibility to provide an accurate address and to check pin-code serviceability to receive products on time.

Pin-Code Serviceability :

We ship throughout India to almost all pin-codes. The list of pin-code serviceability might change from time to time depending on our logistics partners. You can check if we deliver to your shipping address by typing in your pin-code on any of our product pages by entering your shipping details on the checkout page. Although we have made all our efforts to ship to serviceable pin codes, however there may be few pin codes which may not be serviceable by our logistics service providers. User need to check his pin code at the time of placing the order. It is the customer’s responsibility to provide an accurate address and to check pin-code serviceability to receive products on time.

Order Tracking :

Once your order has been processed dispatched from our warehouse, you shall receive a confirmation email, on the email address provided by you at the time of placing your order with us, containing the details of the tracking number and the logistic partner that is processing your order. Alternatively, if you are a registered user, you can track your order by logging into the “My Account” section of our Website by using the username and password created at the time of your registration, and then clicking on the “Your Orders” tab to view your order details.

Dispatch Timeframe :

Most orders are processed and dispatched within 1–2 business days of order confirmation.

Delivery Timeframe :

At the time of placing your order, depending at your place of residence, an estimated time of delivery would be shared with you. Once the order is shipped the consignment number for tracking the status of your order would be shared with you. Usually an estimated time of delivery (after handing over products to our delivery partner) will be for

A) Metro cities: 3–5 business days

B) Tier 2/3 cities & rural areas: 5–10 business days

We will try its level best to make sure that you receive your order as fast as possible but due to certain external circumstances, your order might take a while longer to get delivered. However, THE HERB SHOP is not liable for any delay in delivery by our logistics partner.

Shipping & Delivery Charges :

Shipping and handling charges depends on product price, packaging size and other considerations. This amount will be charged to your total bill at the time of placing your order with us on the Website. Untill changed, a shipping and handling charge of INR 75 will now be applicable on all orders below INR 499.

COD (Cash On Delivery) :

COD (Cash On Delivery) is not available for our products.

Risk of Loss :

All Products are at your risk from the time of delivery by the courier partner.

Shipping and Delivery Disclaimer :

A) All deliveries where applicable shall be made on a best efforts basis, and while the Website will endeavor to deliver the Products on the dates intimated. We are not responsible for delays due to customs, postal services, or force majeure events (e.g., natural disasters, pandemics, etc.) and the THE HERB SHOP disclaims any claims or liabilities arising from any delay in this regard.

B) If you refuse or fail to take delivery of Products provided in accordance with these Terms, any risk of loss or damage to the Products shall nonetheless pass on you and without prejudice to any other rights or remedies we have all rights to recover damages/ loss from you.

CANCELLATIONS

Cancellation Policy :

Cancellations will be considered only if the shipment has not been dispatched for the order placed with us via our website (www.theherbshop.in). Once the shipment has been dispatched, it cannot be cancelled. You may reject the package upon delivery, and we will initiate a refund after deducting applicable return shipping charges (if any).

Cancellation before shipment :

All cancellation requests must be initiated within 4 hours of placing the order or before your order has been shipped, whichever happens first. If the order or the product that you want has not yet been shipped, you can write to our customer support on care@theherbshop.in for cancelling your order. In such cases, the order will be cancelled and the money will be refunded to you within 2 – 5 days, after the cancellation request is processed.

Automatic Cancellation :

If we suspect any fraudulent transaction or a transaction that defies the terms and conditions of using the Website, we at our sole discretion could cancel such orders with/ without providing any notification to you. If item you ordered is not in stock or immediately available when you submit your order, the order is cancelled automatically and it will be eligible for refund a s per refund policy.

Refund Process when order is cancelled :

In case of cancellation before shipment or automatic cancellation, we process the refund within 2 – 5 business days after receiving your cancellation request. For payments done through credit/ debit cards or net banking, the refund will be processed to the same account from which the payment was made. In addition, you can keep this amount in your wallet, which can be used by you for your future purchases.

RETURNS/ REPLACEMENTS AND REFUND

Due to the nature of herbal products, we do not accept Returns/ Replacements of herbal products if the product is opened or used after delivery of the product to the customer. WE DO NOT RESELL OR REPACK ANY PRODUCTS RETURNED BY A CUSTOMER IF IT IS OPENED OR USED. All orders placed on our website are eligible for Returns/ Replacements only in following conditions.

Returns/ Replacements Eligibility :

A) Product is damaged or tampered with during transit.

B) You have received a product that is different from what you had ordered.

C) Product is expired at the time of delivery.

D) Customer failed to cancell its order within stipulated time.

Returns/ Replacements for Products damaged or tampered with during transit :

We takes due care to store and deliver products by partnering with leading best logistic providers in India to ensure that the products that you have ordered reach you in the best of conditions. However, in the rare case that your product is damaged during shipment or transit, you can request for a replacement or return, following these conditions.

A) The product must be unused, unopened, and must reach us in original packaging with their seals, labels and barcodes intact. (unless something was damaged during transit).

B) The request has to be initiated within a maximum of 3 days of delivery.

Returns/ Replacements for product that is different from what you have ordered :

We take due care to deliver the exact product you have orderd online at our Website. If the product delivered is different from what you have ordered, it will be replaced without any additional delivery cost. No Question asked. However following conditions must be fulfilled.

A) The product must be unused, unopened, and must reach us in original packaging with their seals, labels and barcodes intact. (unless something was damaged during transit).

B) The request has to be initiated within a maximum of 3 days of delivery.

Returns/ Replacements for products that has expired according to label on the product :

We make small batches of our production to deliver the fresh and fully potent products to our customers and it is but impossible to deliver expired products to our customers. If by any reason the product of low repition become expired it is sent to expired section and are meant to destroy as soon as possible. Even if by error the staff have shipped the expired products it will be replaced without any additional delivery cost. No Question asked. However

A) The request has to be initiated within a maximum of 3 days of delivery.

Return/ Replacement of an order in part :

A return can be created if you have ordered multiple products. You can initiate a return/ replacement/ refund for any individual product. However, any product being returned needs to be returned with its original packaging, seals, labels and barcodes intact as well as any complimentary gift or product which came along with it.

Return/ Replacement of an order in case of cancellation not initiated within stipulated time :

In case the cancellation is not done within stipulated time and the order is shipped at your location, you must recieve the order and than raise the request for return. Our logistic partner will collect the parcel and after recieving the parcel we shall start processing your request for refund. In this case the order amount will be refunded after deducting the shipment charges of both side. We process the refund within 2 – 5 business days after receiving the parcel. For payments done through credit/ debit cards or net banking, the refund will be processed to the same account from which the payment was made. In addition, you can keep this amount in your wallet, which can be used by you for your future purchases. However

Returns/ Replacements Process :

Follow these steps for raising online request for a return/exchange.

A) Raise your request for a return/ replace via email (care@theherbshop.in) within a period of 3 days from the receiving the order.

B) Kindly attatch with email images of the product, clearly showing the batch number, the invoice, the seal and the product packing for our reference.

C) Provide us with your order ID and the reason to return/replace your order.

D) We will pick up the products within a period 4 – 7 business days of receiving your request. Once we receive the products back, we will initiate the refund or replacement process.

E) Upon approval, we will initiate: A replacement (where stock is available) or a full refund via the original payment method.

Refund Process :

In case of order is returned, we process the refund within 5 – 10 business days after receiving your refund request, for it takes 2 – 5 business days from the date of us receiving the products back. For payments done through credit/ debit cards or net banking, the refund will be processed to the same account from which the payment was made. In addition, you can keep this amount in your wallet, which can be used by you for your future purchases.

SEVERABILITY

In the event that any provision of these Terms of Use and/ or Policies shall be unenforceable or invalid under any applicable law or be so held by a court of competent jurisdiction, such enforceability or invalidity shall not render these Terms of Use and/ or Policies unenforceable or invalid as a whole. Only the part of Terms of Use and/ or Policies (held unenforceable or invalid) shall be modified, to the extent possible, to make it enforceable and valid in the courts of competent jurisdictions. AND If for any reason a court of competent jurisdiction finds that any provision or portion of these Terms to be illegal, unenforceable, or invalid under applicable law in a particular jurisdiction: All the above noted Terms will not be affected in other jurisdictions to the extent that such determination or finding has no application; and It will be applicable in the relevant jurisdiction. The remainder of these Terms (to the fullest extent permitted by law) will continue in full force and effect.

FORCE MAJEURE

We shall not be liable to you nor held in breach of contract for any loss or damage which may be suffered as a direct or indirect result of us being prevented, hindered or delayed in the performance thereof “if” there are circumstances beyond our competance and reasonable control, caused by the Act of God or the Act of State ( including but not limiting to natural disasters, pandemics, war, riot, civil disturbances, legislative actions, government action, explosion, fire, flood, storm, droughts, earthquake, accident, strike, lock-out, trade dispute, disruption in suppy chains or labor disturbance, breakdown of plant or machinery, interruption in the supply of power or materials, suspension or cancellation of THE HERB SHOP licence etc. ). In such event when Parties to the agrement are not in a position to perform their obligations, such party/ies shall not be liable to pay the other any compensation or damages whatsoever.

INDEMNITY

You agree to defend, indemnify and hold harmless THE HERB SHOP, its employees, directors, officers, agents and their successors and assigns, its holding, subsidiaries, affiliates, partners or licensors from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney’s fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to THE HERB SHOP or any third party including but not limited to breach of any warranties, representatives or undertakings or in relation to the non-fulfillment of any of your obligations under the Terms of Use or arising out of your violation of any applicable laws, regulations including but not limited to intellectual property rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of the Terms of Use.

NOTICES

Any notice or other communications in relation to our contract may be given by sending the same by e-mail to the latest address and contact that one party has notified in writing to the other. Except as set out above in relation to cancellation of consumer orders, such notices or communications (where properly addressed) shall be considered received, when sent by email, on the earliest of (i) the email being acknowledged by the recipient as received; (ii) receipt by the sender of an automated message indicating successful delivery or the email having been opened; or (iii) the expiry of 48 hours after transmission, provided that the sender has not received notification of unsuccessful transmission.

GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of India, as promulgated/ modified/ amended or replaced from time to time. It shall govern the validity, performance and construction of this “Terms” without giving effect to any conflicts of law provision.

JURISDICTION

In case of any dispute, you are encouraged to first contact our customer care to seek resolution. If the dispute remains unresolved, it shall be subject to the exclusive jurisdiction of the courts of Sriganganagr, Rajasthan, India-335001.The language of any dispute resolution procedure or any proceedings will be Hindi/ English.

CUSTOMER SUGGESTION / FEEDBACK
